The Fun and Sun web site service is offered to you conditioned on your acceptance without modification of these Terms and Conditions.
Your use of the Fun and Sun
web site offer constitutes your agreement to these Terms and Conditions.
All content that is designed by Fun and Sun and is used on the web site will be Copyright of Fun and Sun with the exception of
customer-supplied artwork, customer-supplied
information and bespoke designs.
You will allow us to place a small advertisement for Fun and Sun at the bottom
of the page for the Template Packages only. Fun and Sun reserve the right to
change this advertisement at any time.
Fun and Sun will either supply a web site template for your use or create a bespoke design dependent on the package you select,
costs are posted on the relevant pages within this web site. All costs are payable yearly in advance after your initial 14 day
trial period. The offer of a free domain name is restricted to .co.uk domain names and the domain name is only registered once
the 14-day trial period has elapsed and payment has been received. Fun and Sun retain ownership of the .co.uk domain
name at all times.
Discount Qualification:
Introduce a friend to Fun and Sun and as soon as they sign up and their payment has cleared you will receive a 25% discount on
your
own
subscription
for
life.
Any discounts/refunds are applied
at the time of your subscription renewal.
The web site cannot be modified in any way except via your personal control panel. Any updates must not be in contravention of
these Terms and Conditions. The web site cannot be hosted by any other company or service. Fun and Sun retain copyright on all
designs.
Your web site will be submitted to the following internet search engines; Google, Yahoo, Ask Jeeves, All The Web, AOL Search,
HotBot and Altavista. There
is no guarantee when your web site will appear on these search engines.
Fun and Sun reserve the right to disable without warning any site that Fun and
Sun deem unsuitable without refund of your subscription, for example:

Those that would violate any applicable law, regulation or third party right;

Those encouraging illegal activity or racism;

Those that promote or utilise software or services designed to deliver unsolicited e-mail;

Those advertising any materials, products and/or services related to pornography.

Links to other web sites and/or pages of the internet is not permitted.

Fun and Sun also reserve the right to disable without warning any site that is in contravention of these terms and conditions
without refund of your subscription.
MODIFICATION OF THESE TERMS AND CONDITIONS
Fun and Sun reserves the right to change the Terms and Conditions at anytime, effective upon making the modified provisions available
on the Fun and Sun web site. You are responsible for regularly reviewing these terms and conditions.
Continued use of the Fun and Sun web site offer after any such changes shall constitute your consent to such changes.
Fun and Sun does not and will not assume any obligation to notify you of any changes to the Terms and Conditions.
NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of the Fun and Sun web site offer, you warrant to Fun and Sun that you will not use the Fun and Sun
web site offer for any purpose that is unlawful, or prohibited by these Terms and Conditions (as the same may be modified from
time to time). In addition, you may not link to the web site any site containing an inappropriate, profane, defamatory, infringing,
obscene, indecent or unlawful topic, name, material or information, or material or information that violates any applicable intellectual
property, proprietary, privacy or publicity rights. You must own the rights to any photographs and text you place on your web
site, Fun and Sun are not responsible for any copyright infringements and any costs or claims arising from such infringements
will be borne by the person, company or organisation who registered for our web services and/or subscriptions.
LIABILITY
Fun and Sun shall have no liability for the accuracy of the information contained in the web site, or for delays, service failures
or omissions therein. Fun and Sun shall not be liable for any third party claims or losses of
any nature, including, but not limited to, copyright infringements, lost profits, punitive or consequential damages. Fun and
Sun reserves the right to remove
any
item in its
database that is not deemed appropriate, or abuses the decency of Internet etiquette. Fun and Sun is not responsible for any
losses or liabilities associated with the web site. You agree to defend, indemnify and hold Fun and Sun harmless from and against
any and all claims, losses, liability costs and expenses (including but not limited to legal fees) arising from your violation
of these Terms and Conditions, or any third-party's rights, (including, without limitation, infringement of any copyright, violation
of any proprietary right and invasion of any privacy rights). These obligations will survive any termination of your relationship
with Fun and Sun.
